How does the severance pay calculator work?

The severance pay calculator allows you to know how much money you are entitled to receive according to the type of dismissal you have suffered. The severance calculation varies depending on whether it is an unfair dismissal (33 days per year worked), objective dismissal (20 days per year), procedural disciplinary dismissal (no compensation) or temporary contract termination (12 days per year). Our dismissal compensation calculator is updated with 2026 labor regulations.

How to calculate severance pay?

To calculate dismissal compensation, enter the start date and end date of the contract, your annual gross salary and the dismissal type. The severance pay calculator automatically calculates your daily salary (annual salary / 365 days) and multiplies it by the number of days corresponding to the dismissal type and years worked. The unfair dismissal calculation also considers whether you worked before or after the February 2012 labor reform, as previous contracts have higher compensation (45 days vs 33 days).

Dismissal types and compensation

There are different types of dismissal and each has its own compensation: Unfair dismissal (when reasons are not proven): 33 days per year with a cap of 24 monthly payments. Objective dismissal (for economic, technical or production reasons): 20 days per year with a cap of 12 monthly payments. Procedural disciplinary dismissal: no compensation. Null dismissal (violation of fundamental rights): mandatory reinstatement. Temporary contract termination: 12 days per year worked. To calculate severance pay correctly, it is essential to first identify what type of dismissal you have suffered.

Frequently Asked Questions

How is severance pay calculated?
Severance pay calculation depends on the type: Unfair dismissal: 33 days per year worked (or 45 days if contract started before February 2012). Objective dismissal: 20 days per year. Procedural disciplinary dismissal: no compensation. To calculate severance pay, multiply your daily salary (annual salary / 365) by the corresponding number of days and years worked.
How much compensation do I get for unfair dismissal?
In an unfair dismissal, the compensation is 33 days of salary per year worked with a maximum cap of 24 monthly payments. If your contract started before February 12, 2012, the part worked until that date is calculated at 45 days per year (cap 42 monthly payments) and the rest at 33 days. The unfair dismissal calculation is based on gross annual salary divided by 365 days.
What is the difference between severance pay and settlement?
The settlement is what the company owes you for your work until dismissal day (pending salaries, unused vacation, prorated bonuses). Severance pay is an additional amount paid as compensation for contract termination, varying by dismissal type. Both amounts are usually paid together on the last day. Use our severance pay calculator to know only the compensation part.
How much is the compensation for objective dismissal?
Objective dismissal (for economic, technical, organizational or production reasons) has a compensation of 20 days of salary per year worked with a maximum cap of 12 monthly payments. The objective dismissal calculation is done by multiplying your daily salary by 20 and by years worked. If the result exceeds 12 months of salary, the cap is applied.
Does procedural disciplinary dismissal have compensation?
No. Procedural disciplinary dismissal does not generate right to compensation. You only have right to settlement (pending salaries, unused vacation, etc.). However, if you disagree with the dismissal reasons, you can challenge it. If a judge declares it unfair, you would have right to unfair dismissal compensation (33 days per year).
How is daily salary calculated for compensation?
To calculate daily salary, divide your annual gross salary (including extra payments) by 365 days. For example: if you earn €30,000 per year, your daily salary is 30,000 / 365 = €82.19 per day. This daily salary is used in the severance pay calculation. Our dismissal compensation calculator does this calculation automatically.
What happens if my dismissal is declared null?
If your dismissal is declared null (for example, for violation of fundamental rights, discrimination, during maternity leave, etc.), the company is obliged to reinstate you immediately and pay you procedural salaries from dismissal until reinstatement. In these cases, no compensation is calculated because the contract is not terminated, the dismissal is annulled.
What compensation corresponds to temporary contract termination?
In the termination of a temporary contract at the end of its duration, a compensation of 12 days of salary per year worked corresponds. There is no maximum cap. For example, if you worked 2 years with an annual salary of €24,000, your daily salary is €65.75 and your compensation would be: 65.75 × 12 × 2 = €1,578. Use our dismissal compensation calculator selecting "Temporary Contract Termination".
